LUTube Terms and Conditions
- Your acceptance
By using and/or visiting the University of Leeds (the "University") LUTube service (collectively, including all content and functionality available via the LUTube website) you signify your agreement to these terms and conditions. If you do not agree to any of these terms please do not use the LUTube service.
- Your provision of material
Only authorised users can upload material to LUTube. In order to upload you must log into your LUTube account using your ISS userid. If you have not logged into LUTube previously your account will be created for you automatically. You are solely responsible for activity which occurs on your account and you must keep your account password secure. Use of your ISS userid and thus your LUTube account is subject to the University's Information Security Policies which are available at http://campus.leeds.ac.uk/isms/
In uploading material to LUTube you assure that any material you upload to LUTube is not done so in violation of copyright either in the uploading or subsequent making available of that material. Failure to comply with this requirement could constitute a criminal offence under The Copyright, Designs and Patents Act 1988. Material which would be deemed illegal must not be uploaded under any circumstances. If you do so you may be committing a criminal offence under various Acts of law. If you are uploading material of a sensitive nature you must ensure that access to this material is suitably controlled, for example by group controlled access.
LUTube claims no intellectual property rights whatsoever on any material which you provide to LUTube. However, in providing material you hereby grant LUTube non-exclusive license to reproduce, store, make derivative works of, display, perform and generally make available this material with no royalty fees whatsoever to LUTube. You also hereby grant any user of the LUTube service a non-exclusive license to access, use, reproduce, display and perform your material with no royalty fees.
You must abide by any JANET Acceptable Use Policy and University Policies, Standards and Codes of Practice relevant to the use of computers, software and networks that are in place at any time, including those specific to faculties/departments as applicable. The JANET Acceptable Use Policy can been found at http://campus.leeds.ac.uk/isms.
The Data Protection Act 1998 regulates the use and storage of personal information (i.e. any information which identifies a living individual) on computing systems. It is your responsibility to ensure that your information complies with this law. Failure to do so could result in criminal charges being brought against both you and the University. The University's Code of Practice on Data Protection can be found at http://campus.leeds.ac.uk/dpa/.
- Your use of LUTube
You must not do anything maliciously, negligently or recklessly which might cause harm of any sort to LUTube. In this context the word harm is taken to mean any kind of damage, and any kind of unauthorised access or alteration.
You are solely responsible for your conduct and any material and/or data of any form that you submit to the LUTube service.
You agree not to use or launch any automated system (for example robots, spiders, offline readers) that accesses LUTube in a manner that sends more requests to LUTube in a given period of time than a human can reasonably produce in the same period of time. Notwithstanding the foregoing, LUTube grants permission to the operators of public search engines to deploy automated systems to copy material from LUTube for the sole purposes of creating and maintaining publicly available searchable indices of the material, but not caches or archives of such material. You agree not to collect or harvest any personal information from the Website. You must not create or submit unwanted email to any LUTube members. In your use of LUTube you will comply with these terms and conditions, and all applicable local, national and international laws and regulations.
Violation of any of these terms will result in the termination of your LUTube account and may result in the suspension of your ISS account and/or further action on the part of the University.
- Liability, Warranty and Related Matters
We reserve the right to modify or terminate the LUTube service or any aspect of it for any reason, without notice at any time.
Whilst every reasonable endeavour is made to ensure that the IT/IS and networking facilities are available as scheduled and function correctly, no liability whatsoever can be accepted by the University for any direct or consequential losses or delays as a result of any system malfunction.
Whilst every reasonable endeavour is made to ensure the integrity of software products, the University does not offer any warranty on any software or its support. Accordingly, no liability can be accepted in consequence of any such product producing incorrect results or failing to work as documented. Responsibility for ensuring that software is suitable for the purpose for which it is used, or that any result obtained through IT/IS or network facilities is correct, always rest with the respective individual.
Whilst every reasonable endeavour is made to ensure the integrity and security of information held on computer media, no consequent liability can be accepted as a result of any such information being inadvertently lost, corrupted or inappropriately accessed.
Whilst every reasonable endeavour is made to ensure the accuracy of advice and information provided by the University, no liability can be accepted by the University for any consequential damages or losses arising from its use.
Any loss of, or damage to, data is not the responsibility of LUTube. Use of this service is at your own risk. Please note that LUTube should not be treated as a storage repository. LUTube’s main function is online conversion of video to web ready formats and the playback and redistribution of converted video. LUTube does not guarantee to retain original uploaded copies of video and it is your responsibility to ensure that you have stored and backed up your own work.
